The Workplace Relations Commission upheld Sean McCann’s annual leave complaint against Florica Tudor Cafe Express Kiosk 12 and awarded him €455 compensation. The decision was dated 25 July 2023. McCann said he did not receive annual leave during his employment, which ran from March to July 2022. The respondent did not attend the hearing. The officer found it was correctly named and considered the period from 1 April to 8 July 2022; any complaint relating to the leave year ending 31 March 2022 was outside the time limit. The officer found McCann worked 520 hours in the period considered. The law provides annual leave based on 8% of hours worked, subject to a maximum of four working weeks. The WRC upheld the complaint and directed the respondent to pay compensation.
