The Workplace Relations Commission said it had no jurisdiction over Desmond O sullivan’s unfair dismissal complaint against Shanside Transport Ltd because it found he was engaged as an independent contractor. The decision was dated 11 September 2023; the merits were not decided. O sullivan said he had worked continuously across two transport franchises from 2018 to 2022. The company said he was self-employed, invoiced for his services and handled his own tax and work-related costs.
