The Workplace Relations Commission awarded Shane Fagan €6,000 after finding he was constructively dismissed by Eiratech Robotics Limited. The decision was dated 24 July 2023. Constructive dismissal means an employee resigns because the employer’s conduct amounts to a serious breach of the employment contract. The WRC found the company’s failure to pay wages was a fundamental breach. Fagan resigned and found another job within a month. The company said it relied heavily on Russian investment affected by the war in Ukraine and denied breaking employment laws. It also awarded Fagan €1,500 for an unlawful deduction of a finder’s fee. The National Minimum Wage complaint was not well founded, and a second Payment of Wages complaint was not well founded; the decision described it as a repeat of the first.
