The Workplace Relations Commission found Nadia Mielcarek’s holiday pay complaint against Kenneth Gilmer not well founded after she did not attend the hearing; the merits were not decided. The decision was dated 28 July 2023. Mielcarek sought holiday pay she said she had not received. Gilmer attended the hearing and said the holiday pay had been discharged. The adjudicator was satisfied that Mielcarek had been notified of the hearing, but she did not attend or give a reason for her absence. The complaint was found not well founded under the Organisation of Working Time Act 1997.
