The Workplace Relations Commission ruled that five complaints Siobhan McNally brought against Rotunda Hospital were outside the statutory time limits. The decision, dated 10 June 2024, said the WRC had no jurisdiction to adjudicate on them; the merits were not decided. McNally alleged discrimination, harassment, victimisation and penalisation connected with her retirement and pension. The hospital argued that the complaints were late. The adjudicator found they were submitted almost four years after the relevant employment termination and rejected the argument that pension payments made the alleged conduct ongoing.
