The Workplace Relations Commission ordered 5 Star Facility Services Cleaning Company to pay Samantha Moloney €845, equal to four weeks’ gross pay, after finding it had not provided her with written terms of employment. The decision is dated 14 May 2024. Moloney said she worked as an area manager overseeing sites in Limerick and had no written statement of her terms. The company disputed her role and said it had issued a statement. The adjudication officer found it more likely that no written statement had been given, and that its absence contributed to difficulties Moloney faced with an incoming contractor. Her separate complaint under the Transfer of Undertakings rules was not well founded. The officer found that the company had initially given the incoming contractor inaccurate information about Moloney’s role, but that this did not breach the rules in the circumstances.
