The Workplace Relations Commission ruled it had no jurisdiction to hear Roseanne Kelly Smith’s unfair dismissal complaint against Last Passive Ltd T/A Aircoach because she referred it more than six months after her employment ended. In a decision dated 28 May 2025, the WRC said she had not established reasonable cause to extend the time limit. Smith said she had no alternative but to resign because of her line manager’s conduct. The WRC found her explanation for the delay speculative and unsupported by direct evidence from a witness. It made no award.
