The Labour Court upheld the decision that Marek Bartosik received a Sunday premium through the composite daily rate paid by Citi Bus Ltd. Its determination was dated 9 June 2023 and found no breach of the Organisation of Working Time Act 1997 during the period considered. Bartosik said he received the same daily rate whether or not he worked on a Sunday. Citi Bus said its rate included a 33% Sunday premium based on an eight-hour day. The Court noted that Bartosik’s signed contract said the rate included the premium, and that he did not dispute the company’s evidence about how it was calculated.
