The Labour Court upheld the rejection of Daniel Hayden’s complaint that Bausch Health Ireland Limited T/A Bausch and Lomb undercalculated his public holiday pay. In its determination dated 3 July 2023, the Court found that the payments for the four holidays met or exceeded his statutory entitlement. Hayden worked 12-hour shifts and argued that his regular overtime should have been included when calculating pay for holidays he did not work. The employer said it had followed the statutory rules. The Court found that the treble-time payment for hours Hayden worked on 1 January 2022 exceeded the required amount, and that overtime was excluded from the calculation for the three holidays when he was off duty. All four complaints were found not well founded, and the Adjudication Officer’s decision was upheld.
