The Labour Court allowed Seda (Skills & Enterprise Development Academy) Limited’s appeal and set aside the Adjudication Officer’s decision in Melissa Angarita Cardenas’s victimisation complaint. The determination was dated 19 July 2023. Cardenas said her suspension was linked to an earlier equality complaint. SEDA said it followed her handling of confidential student records and forwarding work emails to her personal account while on sick leave. The Court said SEDA’s disciplinary handling was poor, but found no evidence that the suspension or disciplinary action was connected to her earlier complaint.
