The Labour Court allowed Seda (Skills & Enterprise Development Academy) Limited’s appeal and set aside the Adjudication Officer’s decision on Melissa Angarita Cardenas’s race discrimination complaint. The determination was dated 19 July 2023. Cardenas said SEDA replaced her marketing work with a full-time employee who had less sales and marketing experience, and that nationality was the only difference between them. SEDA said her marketing duties were temporary after she moved into a full-time receptionist role, pending recruitment of a replacement. The Court found she had not established facts sufficient to support an inference of discrimination and accepted evidence that the duties would continue only until a replacement was hired.
