Labour Court raises penalisation award to €30,000 for dentist dismissed after invoking permit terms

By Gráinne Nolan

Labour Court ·

The Labour Court increased a penalisation award to €30,000 for Dr Min Ling, varying an Adjudication Officer’s €14,378 award on The Square Dental Services Limited’s appeal. The decision was signed on 6 June 2024.

The Court found the employer dismissed Dr Min Ling after she invoked the terms of her employment permit and refused a revised contract requiring extra hours. It rejected the employer’s account that the dismissal was based on clinical performance and workplace fit, citing a lack of supporting records and the absence of a disciplinary process or improvement plan. The Court directed payment within 42 days.
