The Labour Court varied an Adjudication Officer’s decision in Sean Reilly’s appeal against the Minister for Enterprise, Trade and Employment, finding it lacked jurisdiction to consider his fixed-term work complaint. The decision is dated 24 May 2024. Reilly said he was a worker and had received less favourable pay and other conditions than comparable permanent staff. The Minister argued he was not working during the relevant period. The Court determined that the contractual relationship ended no later than 3 July 2018, before the complaint’s limitation period, which ran from 27 August 2018 to 26 February 2019. It therefore had no jurisdiction to consider the substantive complaint; the merits were not decided.
