The Labour Court varied an earlier decision in Sean Reilly’s fixed-term work appeal, finding it had no jurisdiction to consider his complaint against the Minister For Enterprise Trade and Employment. The decision was dated 24 May 2024. The merits were not decided. Reilly argued that his successive fixed-term contracts exceeded four years and that he qualified as a worker under the Act. The Minister argued that he had stopped providing services before the relevant limitation period. The Court found the contractual arrangement ended no later than 3 July 2018, before the period it could examine began on 27 August 2018. The Adjudication Officer had not upheld the complaint.
