The Labour Court set aside a €5,440 minimum notice award to Desmond O’Farrell after allowing his employer’s appeal in a decision dated 11 July 2023. O’Farrell had claimed eight weeks’ notice after resigning. The Court said he could not succeed in a minimum notice claim because it had found in a linked appeal that he was constructively dismissed. The earlier award was set aside.
