The Labour Court rejected Linda Maguire’s appeal against a finding that her minimum notice complaint against Tesco Ireland Limited was not well founded. The Court’s determination was dated 26 July 2023. Maguire had worked as a customer assistant from August 2008 until she was dismissed for serious misconduct on 25 October 2019. Tesco’s policy provided for no notice in cases of serious misconduct. In a linked appeal, the Court had found that her dismissal was not unfair. It concluded that she had no entitlement to notice under the Act, so her appeal failed and the original decision was upheld.
