The Labour Court set aside a €4,648.80 award to John Mckenna after Hamilton Park Care Centre Limited Hamilton Park Care Facility appealed. The Court’s decision was dated 1 August 2024. McKenna had complained that he did not receive his statutory minimum notice when his employment ended. The adjudication officer found in his favour, but the employer said the notice pay had been paid and the complaint had been withdrawn at the first hearing. The Court accepted the employer’s evidence, supported by a payslip and correspondence from McKenna’s representative, that he received eight weeks’ notice pay of €4,648.80 in his final payment. McKenna did not attend the appeal hearing.
