The Labour Court refused Velimir Eldic an extension to bring his Payment of Wages complaint against Unit D & E Bwg Foods Unlimited Company, and his appeal failed. The Court’s decision was signed on 1 August 2024. Eldic accepted that his complaint was filed one day beyond the six-month limit, which followed the end of his employment on 28 January 2022. BWG Foods argued the claim was out of time. Eldic sought extra time, citing an internal appeal and other circumstances, including his misunderstanding of when the statutory deadline began. The Court said he had not explained how those matters excused the delay and found that misunderstanding the time limit did not establish reasonable cause, the legal test for extending it. The Court varied the adjudication officer’s decision accordingly.
