The Labour Court upheld the decision rejecting Sharon Brennan’s claim that Tesco unlawfully deducted €824 from her wages for sick pay. The Court’s determination, dated 18 July 2023, said no breach of the Payment of Wages Act occurred and the appeal failed. Brennan argued that Tesco deducted €824 even though she received only €8 in illness benefit. Tesco said its sick-pay policy required a pro-rata deduction for her part-time hours. The Court found that she had been paid what was properly payable under the policy.
