The Labour Court has upheld the decision that Liam O’Grady’s complaint against ESB Networks was not well founded, dismissing his appeal under the Payment of Wages Act. The determination is dated 5 July 2023. O’Grady argued that ESB Networks deliberately delayed overtime and allowance payments after he submitted paper claims instead of using its MyTime app. The company said basic wages were not delayed and that the app replaced an obsolete paper timesheet system. The claims concerned non-base payments, and the payments were later made. The Court found that the delay followed O’Grady’s choice to use paper claims despite being advised that this would delay processing. It concluded that no deduction contrary to the Act occurred during the relevant period. The appeal failed, leaving the adjudication officer’s decision in place.
