The Labour Court has upheld the decision that Liam O’Grady’s complaint against ESB Networks was not well founded, dismissing his appeal under the Terms of Employment (Information) Acts. The determination is dated 5 July 2023. O’Grady, a Network Technician, argued that delays to non-base payments breached the fortnightly pay interval in his contract and that he had not received formal notice of a change to his terms. ESB Networks said its MyTime app changed work practices, not pay intervals or employment terms, and that paper claims delayed processing. The Court found there had been no change to salary payment intervals. It said delays arose because O’Grady used the paper system despite being advised that this would delay payment. It also found that the app changed work practices rather than his employment terms, and that he had been informed in advance. The appeal failed, leaving the adjudication officer’s decision in place.
