The Labour Court varied an award to John Bird on Clarity Engagement Solutions’ appeal under the Payment of Wages Act, ordering the company to pay €5,370. The decision was dated 29 May 2024. The adjudication officer had awarded Bird €5,772.75. Clarity Engagement Solutions appealed. The parties agreed that €6,833.34 gross, or €5,370 net, was due for February and March 2023, and that he had received no wages for that period. The company said it had entered liquidation and Bird was subsequently employed by another entity. The court found no evidence that his employment had transferred and concluded that the non-payment was an unlawful deduction from wages. It found the complaint well founded and set compensation at the net wages due.
