The Labour Court set aside an adjudication officer’s decision that Clive Mccarthy’s complaint against Metropolitan Films International Limited was well founded. The Court’s decision was dated 29 May 2024. It found no evidence that the company employed McCarthy and said it had no jurisdiction to hear the substantive complaint, so the merits were not decided. The company appealed the decision under the Terms of Employment (Information) Act 1994. McCarthy’s representative told the Court that he had instructed her to withdraw the appeal, and McCarthy did not attend the hearing. The Court proceeded and found no evidence establishing that he had been employed by the company.
