The Labour Court upheld a recommendation that a driver at South Dublin County Council be restored to a driving route and have a final warning removed. Its decision, which disallowed the Council’s appeal, was dated 29 September 2000. The Court agreed there were exceptional circumstances after an alleged assault on a colleague, while saying assault would normally warrant dismissal. It urged the Council and the Automobile, General Engineering And Mechanical Operatives Union to agree a harassment policy and cooperate in future investigations. The harassment allegations were reported as allegations, not a separate finding.
