Tesco Tralee defeats customer’s Equal Status complaint over mask incident

By Donal Gilhooly

Workplace Relations Commission ·

The Workplace Relations Commission found that a customer’s Equal Status complaint against Tesco Tralee failed after an incident at the store over mask wearing and her behaviour. The decision was dated 26 June 2023. She alleged that she was refused service and that Tesco failed to accommodate her disability, and also claimed discrimination, harassment and victimisation.

The customer said a manager told her to leave and that her shopping was pulled from her hands. Tesco said she shouted abuse at staff and customers and was asked to leave because of her behaviour, not because she was not wearing a mask.

The adjudication officer considered written submissions, evidence from the parties and CCTV footage without audio. The officer was not satisfied that Tesco discriminated, harassed or victimised the customer, or failed to provide reasonable accommodation. The complaint failed.
