The Workplace Relations Commission allowed Noreen McManamon’s appeal against Newport House Hotel’s failure to pay statutory redundancy, ruling that her final gross weekly pay should be used in calculating her entitlement. The decision was dated 25 July 2023. McManamon worked seasonally for 26 weeks a year, with the remainder spent on lay-off. The hotel said it remained committed to paying redundancy and had sent the claim details to the Department of Social Protection for processing. Her representative argued that full gross weekly pay, rather than half, should be used in the calculation. The WRC found she qualified for statutory redundancy after the hotel ceased trading. It ruled that her final gross weekly pay should not be reduced to account for lay-off when setting the pay basis. Only lay-off periods in the final three years before her employment ended were to be excluded from reckonable service. The Department of Social Protection is to approve the amount payable. The decision lists €590 as weekly pay for the calculation, but does not state the total entitlement.
