The Workplace Relations Commission allowed Maureen Gannon’s appeal against Newport House Hotel’s failure to pay statutory redundancy, ruling that her normal weekly pay should be used in calculating her entitlement. The decision was dated 25 July 2023. Gannon worked seasonally for 26 weeks a year, with the remaining weeks spent on lay-off. The hotel said it remained committed to paying redundancy and had sent the claim details to the Department of Social Protection for processing. The parties disputed whether the calculation should use her full gross weekly pay or half that amount. The WRC found she qualified for statutory redundancy after the hotel ceased trading. It ruled that normal weekly remuneration should form the pay basis and that only lay-off periods in the final three years before her employment ended should be excluded from reckonable service. The Department of Social Protection is to approve the amount payable. The decision lists €450 as her weekly pay for the calculation, but does not state the total entitlement.
