The Workplace Relations Commission found Cosmin Bogdan Scarlat’s complaint against Securitas Security Services (Ireland) Limited was not well founded in a decision dated 15 June 2023. Scarlat, a static security officer, said the company had not paid the overtime rate required by the Employment Regulation Order. He argued that hours above 48 in a roster cycle should be paid at time and a half. The company said his contractual pay was higher than the ERO rates and provided records comparing his pay with the amount he would have received under the order. The adjudication officer found that a higher composite rate could meet the overtime rules where the required records were kept and produced. Scarlat did not dispute that his contractual rate exceeded the ERO rate.
