WRC awards Tudor Mereacre €170 for notice breach by Northway Personnel

By Niamh Kearney

Workplace Relations Commission ·

The Workplace Relations Commission ordered Northway Personnel Limited to pay Tudor Mereacre €170 for failing to provide the required notice. The WRC decision was dated 28 May 2024. Mereacre also complained that he had not received written employment terms or annual leave pay, and had been unfairly dismissed. Northway denied the complaints and said it was an employment agency, not his employer for the unfair dismissal claim. The WRC found that the written terms had been provided and that the unfair dismissal and annual leave complaints were not well founded. Mereacre withdrew a separate industrial relations complaint. The WRC found that Northway had breached the statutory one-week notice requirement and awarded €170, approximately one day’s pay. The decision also says that Mereacre’s employment ran from 1 April to 9 December 2021 in its notice analysis, while its background section gives an end date in December 2022.
