Giancarlo Riozzi entitled to statutory redundancy payment after WRC ruling

By Eimear Byrne

Workplace Relations Commission ·

Giancarlo Riozzi is entitled to a statutory redundancy payment after the Workplace Relations Commission found that refusing alternative work was reasonable because of the extra commuting time and costs. The WRC dated its decision 10 May 2024. Riozzi worked for Northway Personnel as a supervisor at a site in Clonee until he was laid off after the work there ended. Northway offered him construction work at other locations on the same pay package, but Riozzi said the jobs were unsuitable because of the travel involved. The WRC accepted that Northway had tried in good faith to retain him, but found there was no job available in his locality and the alternative would require an unreasonable additional daily commute and costs. The payment is based on a gross average weekly wage of €871; the decision sets out the basis for the statutory entitlement. A second redundancy complaint was treated as a duplicate of the first.
