The Workplace Relations Commission found Derek Darbey’s Payment of Wages complaint against St Patricks Hospital was not well founded. In a decision dated 15 May 2024, the Adjudication Officer found a full and final compromise agreement settled claims arising from Darbey’s redundancy. Darbey said he had not received pay increases that applied to staff while he remained on the payroll, and argued that the missed increases reduced his final pay. St Patrick’s Mental Health Services said he signed the agreement after receiving independent advice, settling claims connected with the termination of his employment. The officer found Darbey entered the agreement with informed consent. The pay revisions were approved after he signed, and the agreement’s terms made his complaint irrelevant. The complaint was therefore not well founded.
