The Labour Court recommended that Aer Lingus pay a worker two months’ salary at the full rate applicable in 2019 after finding uncertainty about when his sick leave began. The Court signed its recommendation on 13 June 2023. The worker’s appeal also sought an ill-health gratuity payment and compensation over delays in handling a grievance. The Court did not recommend concessions on either claim, finding the gratuity was discretionary and the delay was not inordinate. A separate claim to extend paid sick leave to reflect pandemic circumstances was withdrawn at the hearing.
