The Labour Court has rejected Mohsin Moola’s appeal over his on-call allowance, affirming the adjudication officer’s decision. The determination is dated 17 July 2023. Mr Moola, a medical doctor employed by the Irish Prison Service, claimed he was contractually entitled to a weekly allowance of €199.39. The service said the higher payments he had received earlier were caused by a payroll calculation error, and that no individual agreement entitled him to a doubled allowance. The Court found no authorised agreement for the higher allowance and concluded that €94.71 a week was properly payable and had been paid during the period covered by the complaint. It decided that no unlawful deduction had been made, so Mr Moola’s appeal failed.
