The Labour Court has varied an award to station manager Mr Nicholas Moroney, directing Iarnród Éireann to pay him €10,000 compensation for loss of earnings. The determination is dated 17 July 2023. The company appealed an adjudication officer’s decision ordering €5,000, arguing that Mr Moroney was excluded from the compensation process because he retired in January 2022. His union said he had already incurred losses before retiring and qualified for payment. The Court found that Mr Moroney met the requirements of the relevant collective agreement and that the unpaid compensation was a deduction from wages under the Payment of Wages Act 1991. Iarnród Éireann’s appeal failed, and the original decision was varied to provide for the €10,000 payment.
